404 Client's Responsibilities

Realize the applicant and/or recipient has the following responsibilities and explain the responsibilities to the applicant/ recipient.
A. The applicant is responsible for providing an application to the DFS-FO in the form prescribed by DFS.
B. The application is to be complete, except for a SNAP expedite application (see Sections 405 and 406) which requires only the name and address of the applicant and the signature by the applicant or the applicant’s authorized representative (applicant only for POWER).
C. The appropriate application is to be completed as specified for the following programs:
1. Allow the client the choice of completing the DFS100 or DFS100S;
2. Require completion of the DFS100 or DFS100S or a written request from a POWER recipient for the Child Care Program;
3. Require completion of all required questions on the DFS100 or DFS100S for SNAP;
4. Require completion of the DFS100 or DFS100S for the POWER programs.
D. The applicant/recipient is responsible for cooperating with the process of determining eligibility by:
1. Participating in an in-office interview unless a waiver is granted when applying for SNAP; or
2. Providing information essential to the decision on eligibility, including valid documentation of alien status for all individuals who are not U.S. citizens;
3. Providing documents for required verification;
4. Providing a SSN, SS card or providing proof of application for a SSN as specified in Section 605.
E. The applicant/recipient is responsible for notifying the DFS-FO and verifying any changes, which affect eligibility or the performance payment. (see Section 1500)
1. Changes must be reported and verified not later than ten calendar days upon knowing of the change for Child Care;
2. Changes, except income related changes, must be reported within ten calendar days upon knowing of the change for the SNAP program;
3. Changes must be reported immediately upon knowing of the change for POWER.
F. The applicant/recipient must provide information/verification needed about an eligibility factor(s) not later than ten days from the date of a notice of adverse action (see Tables) requesting the information/verification or by the date indicated on the notice for POWER.

G. The applicant/recipient is responsible for providing the DFS 204, Provider Assessment Form, to verify the selected child care provider meets health and safety standards.

H. The assistance unit must cooperate with completion of any quality control review or benefits will be terminated (see Section 1603).
I. The applicant/recipient must provide information regarding Third Party Liability.
J. The applicant/recipient must provide an assignment of rights and information regarding child support and paternity for an assistance unit required to cooperate with child support services.

K. The applicant/recipient and all other mandatory family members are responsible for meeting the Pay-After-Performance work requirements.
L. The applicant/recipient and all other mandatory family members are responsible for signing the IRCU within the following time frames:
1. By Wednesday of the same week if application is made on Monday, Tuesday or Wednesday; or
2. By Wednesday of the following week if application is made on Thursday or Friday of the prior week.
M. Each mandatory applicant/recipient is responsible for registering for work with DWS and meeting with the work program action center and CSA case managers by the date indicated on the appointment form (DFS 501):
1. Determine the contact date and method, in person or by phone, by the availability of the referral source:
a. Contact must be made with DWS and CSA within two working days from the date of application when located in the same town; or
b. Contact must be made with DWS and CSA within five working days from the date of application when not located in the same town; and
c. Contact with the work program action center must be completed by Wednesday of the same week if application is made on Monday, Tuesday or Wednesday; or
d. Contact with the work program action center must be completed by Wednesday of the following week if application is made on Thursday or Friday of the prior week.
2. Include a contact date on the appointment form for each mandatory applicant and immediately forward a copy to:
a. The work program action center;
(1) Do not refer the applicant or recipient when there are no child support issues involved;
c. The DWS for work registration unless job readiness must be assessed by the CM. (The Benefit Specialist will review the weekly/monthly report from DWS for compliance);
d. Other referral resources as appropriate.

N. Each applicant between the ages of 16 and 65 is responsible for completing the Assessment Form (DFS 561) and a copy of the original will be forwarded to the work program action center.
O. The applicant/recipient who has a previous overpayment is required to sign a DFS 707, Installment Contract, as a condition of eligibility and as a performance requirement unless:
1. The case is pending prosecution; or
2. The error cause is an agency error.
P. The applicant/recipient is responsible to apply for and accept income for which the person(s) would be eligible such as, but not limited to, SSI, RSDI, UIB and Workers’ Compensation.
Q. The applicant/recipient is responsible for reporting abandonment/desertion to law enforcement per W.S. 20-3-101 when requesting an additional year beyond the five-year benefit limit due to abandonment/desertion. (Per state statute, the penalty for abandonment is a fine not to exceed $750 or imprisonment for not more than six months, or both.)
