702 Exemptions From Work Registration

A. Perform an assessment of each applicant/recipient to determine if the individual is exempt from the work registration and update the exempt status on WORW whenever the recipient’s status changes.
B. Exempt an individual if s/he is:
1. A child under age 16, including a child who turns 16 within the certification period;
2. Age 16 or 17 and not a head of assistance unit; and
a. Is attending school; or
b. Is enrolled in an employment training program at least half-time.
3. Age 60 or older;
4. Physically or mentally unfit for employment as verified by:
a. Receipt of temporary or permanent disability benefits issued by governmental or private sources (see Section 200, “Disabled” definition);
b. A determination of incapacity (preferably using the DFS 110) which is completed by the individual’s licensed physician, psychologist or master’s level mental health worker;
c. A visual determination of a physical disability by the Benefit Specialist as documented in the case record;
d. Cooperating with the Department of Employment/DVR in the application process for services; or
e. Cooperating with SSA in the SSI application process.
5. A parent or other individual who is responsible for the care of a dependent child under age six;
6. A parent or other individual who is responsible for the care of an incapacitated person;
7. A regular participant in a drug addiction or alcoholic treatment and rehabilitation program;
8. A bona fide student enrolled at least half time in any recognized school, training program or institution of higher education during normal periods of class attendance, vacation and recess (see Section 505);
9. Subject to the requirements of the POWER/POWER-SASFA or Tribal TANF program;
10. A person who has applied for UIB and was required to register for work as a part of the application process or a person in receipt of UIB (see Section 703);
11. Employed or self-employed and working a minimum of 30 hours weekly or receiving weekly earnings equal to at least the federal minimum wage multiplied by 30 hours (see Section 703);
12. Meets 11. and is a migrant/seasonal farm worker who is under contract or similar agreement with an employer or crew chief to begin employment within 30 days.
C. Refer to Section 710 for coding on WORW.
D. Understand changes in exempt status:
1. Are updated the next month when the change is due to a mandatory reporting requirement (see Section 1501); or
2. Are updated at the time of re-certification if the change is not required to be reported.
