                        SNAP Group Living Arrangements/Eligible Foods

SNAP - 7 CFR 273.1, .2, .11, .13, 274.5, 278.1

                        Allow residents of certified group living arrangements to apply for SNAP using the following criteria.

A.    Application:

1.    Drug and alcohol -
Require residents to apply as a one-person assistance unit through an authorized representative.

2.    Disabled per definition in Section 200 -

a.    Require the facility serving disabled individuals to be certified as a nonprofit facility (see list below or contact DFS-FO);

b.    Allow residents to apply as a one-person assistance unit through an authorized representative; or

c.    Allow residents to apply on their own behalf as an assistance unit in accordance with Sections 401 and 506.

3.    Battered women and children
Allow residents to apply on their own behalf as an assistance unit, in accordance with Sections 401 and 506, and separate from the previous abusing assistance unit.

B.    Exceptions:

1.    Battered women and children -

a.    Disregard the income, assets and expenses of the previous assistance unit members and issue an additional allotment only once in a month as a separate assistance unit;

b.    Take prompt action to ensure the former assistance unit's eligibility or allotment reflects the changes in the assistance unit composition, including issuing a notice of adverse action in accordance with Section 1400 and Tables.

2.    Authorized representative -
Issue SNAP to the authorized representative when one exists.

C.   Responsibilities of the resident program:
Require the resident program to comply with the following provisions:

1.    Authorized representative -

a.        Require the authorized representative be a designated employee of the resident program;

b.        Understand the authorized representative will be responsible for receiving and spending the benefit allotment.

2.    Food preparation -

a.    Understand the resident program may purchase and prepare food on a group basis; or

b.    The resident may buy and prepare food for their own consumption when there is not an authorized representative.

3.    Current participants -

a.    Require the resident programs to provide the DFS-FO with a monthly list of current residents who are SNAP participants;

b.    Require a responsible employee to sign and attest to its validity.

4.    Changes -

a.    Require the resident program, who is acting as the authorized representative for the assistance unit, to report changes in each resident's circumstances which may affect eligibility or benefit level; or

b.    Require residents who apply on their own behalf to report changes in  circumstances which may affect eligibility or benefit level.

5.    Resident leaving resident program -
Require the resident program to comply with the following procedures when a SNAP participant leaves the resident program:

a.    Provide the resident with the full benefit allotment when it was issued and none redeemed;

b.    Provide the resident with one half of the SNAP allotment when s/he is leaving the resident program prior to the 16th and some benefits have been spent;

c.    Provide the resident with any remaining unspent benefits when s/he is leaving the resident program after the 16th.

d.    Provide the resident with the resident's JP Morgan card.

e.    Cease to act as an authorized representative.

6.    Misrepresentation Fraud -
Understand, in cases where there is an authorized representative, the resident program has responsibility for any misrepresentation of facts.

                        Eligible Foods

SNAP - 7 CFR 271.2

                        Realize the following foods or food products may be purchased with SNAP:

A.    Any food or food product intended for human consumption except alcoholic beverages, tobacco, hot foods and hot food products prepared for immediate consumption;

B.    Seeds and plants to grow food for the personal consumption by eligible assistance units;

C.   Meals prepared and delivered by an authorized meal delivery service to assistance units eligible to use benefits for delivered meals or meals served by an authorized communal dining facility for the elderly, SSI households or both;

D.   Meals prepared and served by a group living arrangement facility;

E.    Meals prepared and served by a shelter for battered women and children to eligible residents if authorized by Food and Nutrition Services;

F.    In the case of homeless individuals, meals prepared and served by an authorized public or private nonprofit establishment such as a soup kitchen or temporary shelter.  (This establishment must be approved by DFS-SO and authorized by the Food and Nutrition Services before accepting SNAP benefits for meals);

G.   Meals prepared and served by a state certified drug addict or alcoholic treatment center to eligible assistance units.
